Planning Commission Sends Gateway Law To Council Minus Key Provision

The Planning Commission voted at its meeting last night to send its recommendations concerning the Village Gateway ordinance to Village Council. However, they decided to wait on making a recommendation regarding fast-food establishments.

The commissioners want to take another look at the wording of the definition of drive-up, drive-throughs, etc. before sending their recommendation for that section to Council.

Allison Terry, Village Planner, said the Commission should be able to firward something to Council within six weeks.

The critical language in the proposed ordinance is:

"Drive-ins, drive-ups, or drive-throughs in conjunction with a permitted, or approved conditional use, except, that drive-up, drive-through, or drive-in facilities shall not be permitted in or at any fast food enterprise, or any enterprise involving the sale of beverages (for the purposes of this section, a fast food enterprise is a business engaged in the sale of pre-prepared or quickly prepared food and beverages, usually in disposable containers and wrappers, for consumption either on or off premises, in a facility in which a major portion of the food and beverage sales to patrons are at stand-up type counters or drive-in, drive-up, or drive-through arrangements)."

This section of the proposed ordinance was taken from Section 1175.02(b)(8) of the Planning and Zoning Code. That part of the code describes conditional uses within the Suburban Business District. The proposed Gateway Zoning Ordinance is based upon Suburban Business District.
