Denison Appeals!
At 3:41 pm this afternoon, Denison filed a notice of appeal in the 5th District Court of Appeals.
They are appealing Judge Jon Spahr's decision to overturn the decisions of Granville Planning Commission and Granville Village Council that would have permitted Denison to build three "starkly modern" additions onto Cleveland Hall within the carefully regulated historic district of Granville.
The Court of Appeals will wait 30 days to give the appellees (formerly appellants in the case before Spahr) an opportunity to file an objection to Denison's request for an "accelerated calendar" which would deny oral argument before the three-judge appeal court. Under Local Rule 6(B) of the 5th District: "If appellee or cross-appellee objects to the assignment of the appeal to the accelerated calendar, appellee or cross-appellee may file an objection with this Court within thirty days of the filing of the docketing statement and the case shall be assigned to the regular calendar."
The Village of Granville was a party to the original appeal before Judge Spahr, but Village Council, at their meeting on April 2, 2008, voted to not join Denison in appealing Spahr's decision. As a consequence, only Denison will participate in this latest appeal.
