Judge Spahr Moves Hearing On Denison's Reconsideration Motion To April 15

On Thursday, April 3, 2008, James Cooper, attorney for Denison University, submitted a motion to Judge Jon Spahr asking him to reconsider his decision in the Cleveland Hall case. The motion called for a non-oral hearing at 8:30 am on Wednesday, April 9, 2008. The citizen appellants petitioned Judge Spahr to allow more time for a response. Judge Spahr agreed.

In their "MOTION BY APPELLANTS FOR NON-ORAL HEARING ACCORDING TO RULE," submitted to Judge Spahr on April 7, 2008, appellants wrote, "A motion for reconsideration is a serious event for the Appellants. It deserves the fullest opportunity for an optimum effort by their counsel to respond."

Appellants continued, "The law is clear. Civil Rule 6 and Local Rule 5 dictate that Appellants shall have at least seven days from the date of service, plus three additional days when service is by mail. Fairness and justice require that this be the minimum result for the Appellants in the setting of the non-oral hearing in this matter."

This morning, April 8, 2008, Judge Spahr agreed with appellants and orderd the non-oral hearing be held on April 15, 2008 rather than tomorrow as requested by Denison. Click here to view Judge Spahr's jugment order.
