View Council's Discussion of Cleveland Hall Appeal

On April 4, 2008, Council voted 3 to 2 against Steve Mershon’s motion to appeal Judge Jon Spahr’s March 10, 2008 decision. Included in this story is a complete video of the Council’s discussion leading up to the decision not to appeal.

At it’s executive session, five members of Council, Constance Barsky, Lon Herman, Matt McGowan, Stever Mershon, and Deb Tegtmeyer met with Michael Crites, the Village’s Law Director.

Judge Spahr’s decision reversed Council’s June 20, 2007 decision to uphold the Planning Commission’s February 26, 2007 decision to permit Denison University to construct three modern additions to Cleveland Hall.

As a result of Judge Spahr’s decision, the Zoning Permit granted to Denison was no longer valid and construction on Cleveland Hall came to a halt.
